Last Saturday a 62-year-old individual of Pune was arrested who assault a Vistara air hostess. This flyer is recognized as the first person that an airline in the country suggests for insertion in the no-fly list (NFL). It is penal that responsible for the listing of unruly fliers declared by the Union civil aviation ministry six months before.
As per the Vistara airlines, the matter was told to the police on the complaint of an air hostess who was a victim in the assault case. They are waiting for the inquiry to complete. Once it gets complete, then based on the inquiry they will decide whether to name the Pune flyer for NFL or not.
As per the Sanjay Bhatia, DCP (IGI), on March 24, it happened during a Lucknow-Delhi flight landed at Indira Gandhi International Airport in Delhi. The passenger allegedly touched the air hostess in a wrong way despite the fact that exiting the plane.
Bhatia also said “He may have tried this even before alighting. She alerted her seniors immediately and then filed an FIR on the same day.”
Prohibition may range from 3 months to life
A case under Section 354A of the Indian Penal Code that deals with sexual harassment was registered. Later on, the man was freed on bail. The offense is punishable by an extreme imprisonment of three years and a fine. As per the guidelines of civil aviation ministry’s, a person on NFL may be prohibited from three months to a lifetime. This is for “unruly physical gestures”.
The airline spokesperson verifying the March 24 incident, stated, “Vistara does not tolerate abusive or unruly behavior by passengers that puts the safety of its staff and other customers at risk or compromises their dignity. We have told the matter to the police and other relevant authorities. An FIR is registered and an investigation is on. We are fully committed to providing our cooperation to all the authorities.”
The spokesperson also said, “For NFL, we will wait for the investigation to a conclusion, basis which we will decide the next course.”

The procedure for appealing the NFL clause needs the pilot in command or captain of the plane. It is on which the disruptive behavior took place to file a complaint with the airline.
The Vistara airline is going to set up an internal committee. This is to inspect the complaint and to resolve the matter in 30 days. During this period the suspected passenger will be banned from flying on the airline.
If the Directorate General of Civil Aviation places a person on NFL. Only then the other airlines can decide whether to prohibit him or her from flying on their craft or not. However, the decision taken by one airline will not be binding on other carriers.
Last year, before NFL gets implemented there were two known people who were in the air hostess assault case. The two MPs, Shiv Sena’s Ravindra Gaikwad and Telugu Desam’s Diwakar Reddy are there. They both were pulled up, correspondingly, for harassing an Air India staffer. They also threatened an Indi-Go ground staff. Due to this, they both were prohibited by all airlines for a short period.
